1. Introduction
These Terms and Conditions (“Terms”) apply to all CCTV and security system products and services provided by KNEXGEN LIMITED trading as Stealth Guard CCTV (“we”, “us”, “our”) to any client (“you”, “your”). By ordering or using our products or services, you agree to these Terms.
2. Services
2.1 We supply, install, and maintain CCTV and related security systems.
2.2 The scope of services will be confirmed in a written quotation, proposal, or order form (“Engagement”).
2.3 Installation dates and times are estimates and may change due to equipment availability, site access, or third-party factors.
3. Customer Responsibilities
3.1 You must provide safe and reasonable access to the property for installation, maintenance, and removal of equipment.
3.2 You are responsible for obtaining all necessary permissions (e.g., landlord, planning, or local authority) for installation.
3.3 You are responsible for ensuring the lawful operation of CCTV systems, including compliance with the UK GDPR, Data Protection Act 2018, and ICO CCTV Code of Practice. This includes registering as a data controller if required, displaying appropriate signage, and managing footage retention.
3.4 We are not responsible for unlawful use of installed equipment.
4. Equipment and Ownership
4.1 Equipment supplied remains our property until paid for in full.
4.2 Risk in the equipment passes to you upon delivery or installation. You are responsible for insuring equipment once installed.
4.3 Tampering, unauthorised modifications, or repairs by third parties may void any warranty.
5. Warranty and Support
5.1 Unless otherwise agreed, equipment carries a 12-month manufacturer’s warranty, and installations include a 12-month labour warranty.
5.2 Warranty does not cover:
accidental damage, misuse, or neglect,
vandalism or theft,
modifications by unauthorised persons,
network failures, power surges, or environmental damage.
5.3 Maintenance and support contracts may be offered separately. These may include periodic inspections, software/firmware updates, and priority callouts.
6. Deliverables and Footage
6.1 We provide installation and configuration of CCTV systems.
6.2 Unless explicitly agreed, we do not monitor or store your CCTV footage. You are solely responsible for the storage, retention, and lawful use of recordings.
6.3 Reports, manuals, and configuration details provided remain confidential and must not be disclosed to third parties without our consent.
7. Fees and Payment
7.1 Fees for supply and installation will be confirmed in writing before work commences.
7.2 Payment is due between the 24th and 28th of each month for ongoing services, or upon completion for one-off installations, unless otherwise agreed.
7.3 All charges are exclusive of VAT and other applicable taxes.
7.4 Late payments may attract statutory interest and recovery costs in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
8. Liability
8.1 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.
8.2 Subject to clause 8.1, our total liability in any 12-month period is limited to the total fees paid by you for the services during that period.
8.3 We are not liable for:
loss of profits, business, revenue, goodwill, or data,
indirect or consequential losses,
failure of CCTV systems due to misuse, tampering, environmental damage, or third-party services (e.g., internet or power supply).
9. Data Protection
9.1 We comply with applicable data protection laws when processing personal data as part of service delivery.
9.2 You are the data controller of any CCTV footage collected. We act only as a processor where explicitly agreed.
9.3 Our data handling practices are described in our Privacy Policy available on our website.
10. Complaints and Disputes
10.1 Complaints should be submitted via our customer portal at hub.stealthguardcctv.co.uk or by email to hello@stealthguardcctv.co.uk.
10.2 We will aim to resolve complaints fairly and promptly.
10.3 These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the English and Welsh courts.
11. General
11.1 We may update these Terms from time to time. Updates will be published on our website and take effect from the date of publication.
11.2 You may not assign or transfer your rights under these Terms without our written consent. We may subcontract but remain responsible for delivery.
11.3 Notices may be served by email or in writing to the registered office.
11.4 If any clause of these Terms is invalid or unenforceable, the remainder shall continue in force.
